Winthrop and Weinstine attorneys Katherine Johnson and Nick Valle are speaking at the upcoming MCLE Understanding Easements, Licenses and Restrictive Covenants in Minnesota seminar on October 3, 2022.  Their CLE is entitled, “10 Essential Minnesota Cases Construing Easements, Restrictive Covenants and Licenses.”  This session will provide a brief identification and review of the principal cases in Minnesota that define, interpret, and implement the law of easements, restrictive covenants, and licenses. Learn how the courts approach these land interests and the lessons to be learned from each of the cases reviewed.

Jessica Timmington Lindstrom will be presenting at the Minnesota CLE program “Providing and Protecting: Supplemental and Special Needs Trusts,” as part of the Understanding Trusts seminar. Supplemental and special needs trusts are established to benefit a person with a disability by supplementing the government benefits they receive. Attendees will learn the differences and uses of these two trusts. The session will address drafting and funding considerations as well as issues regarding administration.

Winthrop attorneys Tony Moch and Amber Kraemer will be speaking at the ICBM Convention on August 4, 2022.  Their session is titled, “How Can a Bank Implement a Successful Succession Plan,” and they will lead the discussion around setting goals regarding succession planning. Step one: identify the purpose – officer recruitment, retirement, liquidity, general estate planning, lack of successors, etc. Step two: think about the ideal timeline and considerations that go into accomplishing the goal. Step three: determine the steps necessary to accomplish the goal within the intended timeline, including legal documentation and regulatory requirements. Attendees will walk away with an understanding of different key options available with respect to succession planning and the legal and regulatory steps associated with the different options.

This year ICBM will recognize 60 years as an association supporting Independent Community Banks in Minnesota. Innovation and Transformation have been cornerstones for this organization throughout their strong history.

Winthrop attorney Lisa Ellingson is presenting on a panel at the Special Commission on The Hague Adoption Convention.  The Convention is the international treaty that governs how countries are supposed to do intercountry adoptions.  Invited as an expert observer, she will present on post-adoption matters.

Winthrop and Weinstine attorney Christianna Finnern will be presenting, “Best Practices for Maltreatment Report and Investigations” at the 2022 Care Providers of Minnesota Convention.

You have discovered a situation that may rise to the level of maltreatment reportable to MAARC.  What should you do and when should you do it?  Do you have a protocol in place for responding in these situations?  If not, you should strongly consider implementing such a plan so neither you nor your staff are in doubt about who is responsible for taking certain steps in the event of suspected maltreatment, including abuse, neglect, mistreatment and financial exploitation.

From service animals to snakes on a plane, this presentation will teach attendees how to ensure and maintain compliance with ADA service animal guidelines. We have all seen news stories about emotional support chickens, snakes, and birds. But what obligations do Providers have to accommodate animals in patient spaces? How can Providers tell the difference between service animals, emotional support animals, and pets? And how can Providers balance patients’ rights with potential safety concerns?

Winthrop and Weinstine attorneys David Aafedt and Christianna Finnern will be presenting, “How to Prevent Vicious and Malicious Ransomware Attacks” at the 2022 Care Providers of Minnesota Convention.

Are you prepared in the event that your assisted living or skilled nursing facility is hit with a ransomware attack that cuts off access to your computer systems?  What can or must you do if you are suddenly unable to access your patient records, payroll records, order medications or even access the Internet?  This terrifying circumstance is becoming all-too-common but it still can catch operators unaware and unprepared.  This session will discuss what to do if you are targeted.

• Know how to train your staff and monitor threats to avoid attacks on your records.

Jessica Timmington Lindstrom will participate in a panel discussion at the 2022 Probate and Trust Law Section Conference on June 13, 2022. PROBATE AND TRUST LAW SECTION

The panel of attorneys and trustees will discuss the importance of considering Grantor incapacity and how a Trust and its assets and distributions would be managed.  The panel will also look at language in trusts and critically considering how boiler plate language may or may not ensure the grantor’s wishes and goals are achieved in the event of incapacity. Tips to fulfill grantor intent and things to avoid when drafting capacity language in Trusts will also be addressed.
