My Approach

I primarily represent financial institutions and other commercial enterprises with matters related to business disputes. The highlights of my workday come from listening to my clients as they share their problems and concerns with me, and then establishing the best approach for assisting them in meeting their objectives and goals. My clients trust my skills in navigating the legal system and its many nuances, allowing them to maintain focused on running and growing their business. In addition to my role as litigator, I serve as an advocate and trusted business advisor as outside general counsel to many clients. I value and appreciate the trust and confidence my clients have in me and appreciate every day the opportunity to play such an important role in the success of their businesses.

A Groundbreaking Moment in My Career

Before joining Winthrop & Weinstine in 2000, I practiced, for several years, with a small general practice firm where I worked in many areas of the law, embracing the difficult undertakings of litigating large commercial cases, small personal injury matters, and everything in between. I’m grateful for the education and experience I gained in the smaller firm, because it’s where I learned how to issue-spot and get things done.

My Experience

My general business and commercial litigation experience includes the representation of businesses in shareholder, contract, products liability, and employment disputes. My ultimate purpose is to be a committed business advisor to my clients. It’s imperative that they trust me and feel confident that they can depend on me not only for my responsiveness, but especially for my perceptive understanding of their needs and goals as I use my many strategic tools to help them resolve their litigation disputes and get them back to their main purpose, which is running a successful business.

Representative Matters

• Represented property developer in breach of lease dispute relating to Covid-era failure to pay rent.
• Represented national housing developer in civil actions, class action matters, and regulatory compliance matters.
• Represented company in defending against demands brought by the Minnesota Attorney General relating to loans obtained under Covid-era relief.
• Represented agricultural cooperative in breach of contract claims against service provider.
• Represented national business in civil matter against architectural and engineering services provider for breach of contract and failure to meet the standard of care set out in the agreement.
• Representation of a locally famous restaurant in a lease extension dispute.
• Represented propane wholesaler in the enforcement of futures contracts for the purchase of propane

Practicing Financial Services Litigation

My Experience

Within my Financial Services Litigation practice, I focus primarily on creditors’ remedies. I often act as primary outside litigation counsel for clients assisting them with respect to their defaulted commercial loans and defaulted commercial leases. As part of my Financial Services Litigation practice, I assist clients with:

• Contract enforcement issues
• Bankruptcy proceedings, adversary proceedings
• Enforcement and collection of judgments, pre-judgment remedies
• Fraudulent transfers, fraudulent conveyance, fraudulent retention

I strive to build solid, trusting relationships with my clients. Securing the best possible economic resolution helps my clients return to what matters most to them, working to maintain and prosper in their businesses.

Representative Matters

• Representation of specialty finance organizations in connection with various litigation matters in state court, federal court and bankruptcy court around the country.
• Represented community bank in class action matter relating to alleged violations of the Minnesota Deceptive Trade Practices Act and regulatory commentary provided by the Consumer Financial Protection Bureau and the FDIC.
• Representation of a financial institution sued in a class action for, among other things, charging overdraft fees on debit card transactions (referred to by the plaintiff’s class action bar as “APPSN” transactions). We brought an early motion to dismiss the APPSN related claims, which was granted by the Court.
• Defended regional bank against fraud claims brought by borrower.
