In 1976, Minnesota's "favorite son" and United States Supreme Court Chief Justice Warren Burger challenged the legal profession to find a better way to resolve disputes and improve public satisfaction with the administration of justice. Since then, mediation, arbitration and other forms of Alternative Dispute Resolution (ADR) have emerged to offer a potentially less expensive and more satisfying resolution to business litigants.
Today, ADR is both a distinct method for resolving disputes and  a process integrated into traditional litigation. At Winthrop & Weinstine, P.A., we recognize this evolution as an economic and strategic opportunity for our clients when faced with business disputes.

Winthrop & Weinstine’s cutting edge approach to alternative dispute resolution recognizes ADR as not only an alternative to the litigation process, but as part of an overall negotiation and litigation strategy. This unique approach is what makes our firm a leader in ADR practice.

In addition to advising clients on the inclusion of ADR provisions in their contracts and representing parties in ADR processes (summary jury trials, early neutral evaluation, neutral fact finding, MED-ARB, various forms of arbitrations, and mediations, among others), Winthrop & Weinstine also has lawyers who are included on the Minnesota Supreme Court’s Statewide Roster of ADR neutrals who regularly practice as such (mediators, arbitrators, fact finders, etc.).  Inclusion on the roster requires completion of the Minnesota Supreme Court’s Certified Training Program.  In this way, our qualified neutrals have developed valuable insights into the ADR processes, including strategies employed by both litigants/parties  and neutrals.
