Winthrop & Weinstine Secures Third Victory For Local Candy Company in Trademark Suits Against Snack Food Giants
MINNEAPOLIS – Feb. 22, 2016 – Winthrop & Weinstine, on behalf of its client Candyland of St. Paul, Minn., successfully stopped the unauthorized use of its CHICAGO MIX® trademark by Snyder’s Lance, Inc., Garrett Popcorn, and Cornfields Inc., which sells G.H. Cretors popcorn through retailers such as Costco, Whole Foods and Hy-Vee, by securing permanent injunctive relief in Minnesota federal court.  

On Feb. 18, 2016, the federal district court in Minnesota entered the last of three judgments resolving lawsuits began by Candyland in August, 2014, to prohibit the further unauthorized use of its long-standing CHICAGO MIX® trademark.  

“I’m thrilled about the outcome in this real life David vs. Goliath trademark case. These are significant resolutions in favor of Candyland, a local small business favorite to many Minnesotans,” said David Davenport, shareholder at Winthrop & Weinstine who represented Candyland in all three lawsuits. “We were able to protect Candyland’s home-grown, handcrafted and trademark-protected product from further confusion that was taking place in the market because of the use of its signature trademark by other popcorn selling companies.”  

Owned by Brenda and Doug Lamb, Candyland was founded in 1932 and has about 60 employees. The candy company trademarked CHICAGO MIX® for its blend of traditional seasoned popcorn mixed with caramel and cheddar flavored popcorns in 1992. Its CHICAGO MIX® blend has been a best seller for 20 years, both locally and nationally.
