The B and B Hardware Decision and its Effect on Trademark Practice - Webinar

Trademark attorney Stephen R. Baird will review The Supreme Court decision in B&B Hardware, Inc. v. Hargis Industries, Inc., No. 13-352, 2015 WL 1291915 (U.S. Mar. 24, 2015) and how it fundamentally changes the assumption that the right to register a trademark and the right to use it are different rights, to be tried by different tribunals, viewing different facts in different contexts.  Now, a determination of the right to register a trademark by the Trademark Trial and Appeal Board in an opposition proceeding can preclude a separate determination of the right to use a mark by a U.S. District Court in federal trademark infringement litigation.
