Jeffrey R. Ansel Quoted in Minnesota Lawyer Article on Federal Rule of Evidence 502

Winthrop & Weinstine, P.A., litigation lawyer Jeffrey R. Ansel opines on a federal rule that provides an asylum to litigation lawyers during the e-discovery process. Federal Rule of Evidence 502 was put in place to give attorneys a waiver in the event e-discovery documents are accidently shared, if the attorney makes attempts to correct the mistake (Thornton). In “Little-known rule provides a safe haven to lawyers,” Jeff indicates that Rule 502 is more complicated than saying a lawyer messed up. “You can’t just produce everything without trying to find and withhold privileged information solely in reliance on the rules regarding inadvertent disclosure” (qtd. in Thornton).

The article was published in the August, 30, 2010, edition of Minnesota Lawyer.
